Terms and Conditions

These Terms & Conditions (Terms) apply when you use our website at latchit.shop (Website) and when you buy products from us. Please read them before placing an order. When you place an order, you agree to these Terms.
1. About us
The Website is owned and operated by latch it., ABN 48 378 939 068.
In these Terms, "we", "us" and "our" refers to latch it., and "you" refers to the person using the Website or placing an order.
2. Our other policies
These Terms should be read together with our Shipping and Delivery Policy, Returns Policy and E-Gift Card Policy, which form part of these Terms. Our Privacy Policy and Cookies and Pixels Policy explain how we handle, use and manage your personal information.
If anything in one of those policies is inconsistent with these Terms, these Terms apply.
3. Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms or in any of our policies excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If any part of these Terms or our policies would have that effect, it does not apply to that extent.
Our change-of-mind returns offer (see clause 10) is in addition to these rights.
4. Placing an order
By placing an order, you confirm that:
- you are at least 18 years old, or you are placing the order with the involvement and permission of a parent or legal guardian;
- the information you give us is accurate and complete; and
- you are authorised to use the payment method you provide.
When you place an order, we will email you an order confirmation to let you know we have received it. Your order is accepted, and a contract is formed between us, when we dispatch your order and email you a shipping confirmation.
Before we dispatch your order, we may decline or cancel all or part of it if:
- the product is out of stock;
- the product was listed at an obviously incorrect price or with an obviously incorrect description because of a typing or technical error;
- we reasonably suspect fraud or that the payment was not authorised; or
- we cannot deliver to the address you have provided.
If this happens, we will let you know and refund the amount you paid for the cancelled items in full to your original payment method. If an item is out of stock, you can choose an alternative product or store credit instead of a refund if you prefer.
We may limit the quantity of a product that can be bought in a single order. Any limit will be shown on the Website.
5. Prices
All prices are in Australian Dollars (AUD) unless otherwise stated and include GST.
The price you pay is the price shown when you place your order, plus any delivery charge shown at checkout before you pay.
We may change our prices from time to time. A price change will not affect an order you have already placed.
6. Payment
We accept payment through Shopify Payments and Shop Pay, and any other payment methods shown at checkout. Payment is taken when you place your order.
Payments are processed securely by our payment providers. We do not see or store your full card details.
7. Product information
We take care to describe and photograph our products as accurately as possible. Colours may look slightly different depending on your screen settings, and there may be small natural variations in colour, texture or finish between items.
Minor variations of this kind are normal and are not a defect, provided the product still matches its description and is of acceptable quality. This does not affect your rights under the Australian Consumer Law.
8. Delivery
Our Shipping and Delivery Policy explains our delivery options, costs and timeframes. Delivery timeframes are estimates, but we will always aim to deliver your order within a reasonable time.
Your order is our responsibility until it is delivered to the delivery address you gave us, or left at that address in line with any authority to leave you have given. If your order is lost or damaged before then, we will send a replacement or give you a latch it. store credit.
Ownership of the product(s) passes to you once we have received payment in full and delivery has been made to your nominated delivery address.
Please note, where we have evidence or obtained evidence that the product(s) have been delivered to the delivery address, we will not offer a replacement or latch it. store credit.
9. Faulty, damaged or incorrect items
If an item arrives damaged, is faulty, is not as described or is not what you ordered, please contact us via the get in touch form. Our Returns Policy explains how we handle these claims. There is no charge to return a faulty item.
10. Change-of-mind returns
Our Returns Policy sets out the conditions for change-of-mind returns. In summary:
- eligible full-priced items can be returned within 14 days of delivery for store credit; and
- items bought on sale, during a promotional event or using a discount code are not eligible for change-of-mind returns.
These conditions only apply to change-of-mind returns. They do not affect your rights if an item is faulty, damaged, not as described or incorrect.
11. E-Gift Cards and store credit
E-Gift Cards are covered by our E-Gift Card Policy. In summary, E-Gift Cards:
- are valid for 3 years from the date of purchase;
- have no fees after purchase;
- cannot be exchanged for cash, except where the law requires; and
- cannot be used to buy another E-Gift Card.
Store credit issued under our Returns Policy is valid for 3 years from the date it is issued and cannot be exchanged for cash.
12. Promotions and discount codes
Unless we state otherwise:
- only one discount code can be used per order, and promotions cannot be combined;
- discount codes cannot be applied to orders that have already been placed; and
- each promotion is subject to any specific terms published with it.
We may change or end a promotion at any time, but this will not affect an order you have already placed. Giveaways and competitions will have their own terms and conditions.
13. Reviews and content you submit
If you submit a product review, photo or other content to us, you must make sure it:
- is honest and based on your own genuine experience with the product;
- does not contain anything offensive, unlawful or misleading; and
- does not include anyone else's personal information or infringe anyone's rights.
You give us a perpetual, non-exclusive, royalty-free licence to publish your review or content on our Website and social media, with your first name and last initial or first initial and last initial or first initial and last name.
We publish genuine reviews, whether they are positive or negative. We may remove content that is offensive, unlawful, irrelevant, contains personal information or appears not to be genuine, but we will not remove a review just because it is negative. If we offer an incentive in exchange for a review, we will say so alongside the review.
14. Intellectual property
All content on the Website, including our logos, branding, product photography, graphics, website design, text and videos, is owned by or licensed to latch it.
You may view and share links to our content for your personal, non-commercial use. You must not otherwise copy, reproduce, distribute or use our content without our prior written permission.
15. Using our Website
You must not:
- use the Website for any unlawful purpose;
- interfere with the Website's security or operation;
- upload viruses or other malicious software;
- copy or misuse Website content; or
- try to gain unauthorised access to our systems.
We work to keep the Website available and accurate, but we do not guarantee that it will always be available or free from errors.
16. Our liability
If our goods fail to meet a consumer guarantee, you may be entitled to a remedy, as set out in clause 3.
Subject to that, and to the extent permitted by law, we are not responsible for:
- loss or damage that was not reasonably foreseeable including, but not limited to indirect, incidental or consequential;
- loss or damage caused by misuse of a product, normal wear and tear, or not following the product's care instructions; or
- delays or failures caused by events beyond our reasonable control. If this happens, we will let you know and, if your order cannot be supplied within a reasonable time, give you a full refund.
17. Privacy
Our Privacy Policy explains how we collect, use, store and disclose your personal information. Our Cookies and Pixels Policy explains how we use cookies and similar technologies on the Website.
18. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in the law or in how we operate. Any updates will be published on this page with a new "Last updated" date.
The version of these Terms that applies to your order is the version published on the Website when you place it. Changes will not apply to orders you have already placed.
19. Complaints and disputes
If you have a problem with an order or a product, please contact us first via the get in touch form so we can try to resolve it. We aim to respond within 5 business days.
20. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we agree to submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
